Terms of Service

Terms governing accounts, AI video generation, credits, subscriptions, acceptable use, and commercial use on H3Max Video Generator.

Last updated: 2026-09-08

These Terms of Service (“Terms”) govern your access to and use of H3Max Video Generator (the “Service”). By using the Service or purchasing a plan, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and Authority

You must be at least 18 years old and legally able to enter into a binding agreement. If you use the Service for an organization, you represent that you have authority to bind that organization, and “you” includes the organization.

2. Accounts

You must provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account. You may not sell, transfer, share, or misuse an account to evade limits, enforcement, or payment obligations.

3. The AI Video Service

The Service lets you submit prompts, files, and settings to request AI-generated video and audio. Generation depends on third-party model and infrastructure providers, including fal and MiniMax. We do not control their models, availability, moderation, version changes, latency, or output.

H3Max Video Generator is independently operated and is not affiliated with, sponsored by, or endorsed by fal or MiniMax. See our Third-Party AI Services Disclaimer.

4. Your Input and Permission to Process It

You retain any rights you already hold in prompts and files you submit (“Input”). You grant us and our service providers a worldwide, non-exclusive, limited license to host, copy, transmit, modify as technically necessary, and process Input solely to operate, secure, support, and improve the Service.

You represent that you have all rights, permissions, releases, and lawful bases needed to submit the Input and authorize this processing, including for identifiable people, voices, faces, brands, music, copyrighted works, personal information, and confidential material.

5. AI Output

Subject to applicable law, third-party terms, and these Terms, we do not claim ownership of the video or audio generated for you (“Output”). AI Output may be inaccurate, incomplete, offensive, unsafe, non-unique, or similar to content generated for others. We do not guarantee that Output is original, protectable by copyright, free of third-party rights, suitable for a particular purpose, or lawful to publish.

You must review Output before using it and are responsible for your use, publication, disclosure, and distribution of it. Output is not professional, legal, medical, financial, or other expert advice.

6. Acceptable Use

You may not use the Service to create, upload, request, or distribute content that:

  • violates law or another person’s intellectual-property, privacy, publicity, confidentiality, contractual, or other rights;
  • depicts or facilitates child sexual abuse or exploitation, sexual content involving minors, grooming, or trafficking;
  • creates non-consensual intimate imagery, exploitative sexual content, or deceptive impersonation;
  • uses a person’s face, voice, identity, or likeness without required permission, including misleading deepfakes;
  • promotes violence, terrorism, self-harm, hate, harassment, fraud, malware, illegal goods, or dangerous wrongdoing;
  • attempts to bypass safeguards, abuse infrastructure, scrape the Service, reverse engineer restricted systems, or interfere with other users; or
  • falsely presents AI-generated content as authentic evidence where doing so could cause harm.

We may block prompts or Output, remove content, limit access, preserve evidence, or report conduct when reasonably necessary for safety, legal compliance, or enforcement.

7. Plans, Credits, and Free Access

Plan features, prices, credit allocations, watermarks, queue priority, and commercial-use permissions are shown on the pricing or checkout page and may vary by plan. Credits are units for Service usage, not money, property, stored value, or cryptocurrency. Unless required by law or expressly stated at purchase, credits are non-transferable, cannot be redeemed for cash, and may expire under the rules shown with the applicable grant.

Signup, daily, trial, bonus, or promotional credits may have separate limits, expiration rules, and abuse controls. We may withhold or revoke promotional credits obtained through fraud, duplicate accounts, automation, or attempts to circumvent eligibility rules.

Generation may fail or consume different resources based on model, duration, resolution, retries, or provider cost. Any applicable credit cost should be shown before confirmation or in the relevant product interface.

8. Subscriptions, Billing, Cancellation, and Refunds

Paid subscriptions are billed in advance and automatically renew at the interval disclosed at checkout until canceled. You authorize us and our payment processor to charge the applicable price, taxes, and disclosed fees. Cancel before the next renewal to avoid the next charge; cancellation ordinarily takes effect at the end of the current paid period.

Refund eligibility is determined by applicable law and any refund terms shown at checkout. Except where mandatory law provides otherwise, cancellation does not automatically refund the current period, consumed credits, completed generations, or non-recoverable provider costs. Contact support promptly about billing errors. Nothing in these Terms limits non-waivable consumer rights.

We may change future prices or plan features with advance notice where required. A price change does not apply retroactively to a completed billing period.

9. Commercial Use and Watermarks

If a paid plan expressly includes “commercial use,” we permit you to use eligible Output for commercial purposes under these Terms. This permission does not:

  • transfer rights in third-party trademarks, copyrighted material, music, data, faces, voices, or Input;
  • guarantee that AI Output qualifies for copyright or other exclusive protection;
  • replace required licenses, releases, disclosures, labels, or consents;
  • override fal, MiniMax, or other provider terms; or
  • make us responsible for your advertising, claims, products, customers, or distribution channels.

Plans without commercial permission are limited to personal, evaluative, or other non-commercial use. You may not remove or conceal a watermark when the applicable plan requires one.

10. Availability and Changes

Generation speed, quality, resolution, audio, duration, and availability are not guaranteed. Estimates and benchmarks are illustrative and can vary with queue load, network conditions, safety review, retries, and third-party providers. We may add, replace, suspend, or discontinue models and features, or impose reasonable limits, to address cost, security, law, abuse, or provider changes.

11. Our Intellectual Property

The Service, software, interface, branding, documentation, and original site content are owned by us or our licensors and are protected by applicable law. These Terms grant only a limited, revocable, non-transferable right to use the Service. MiniMax, H3 Max, fal, and other third-party names and marks belong to their respective owners; descriptive references do not imply affiliation or endorsement.

12. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, create legal or security risk, fail to pay, abuse credits, or if continued service becomes impracticable due to law or provider action. Where reasonable, we will provide notice and an opportunity to address the issue. Sections that by nature should survive termination will survive.

13. Disclaimers

To the maximum extent permitted by law, the Service and Output are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and accuracy. Some jurisdictions do not allow certain disclaimers, so these exclusions may not fully apply to you.

14. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, business opportunities, or content, arising from the Service, Output, provider failure, or unauthorized account use. Any aggregate liability will be limited to the amount you paid us for the Service during the three months before the event giving rise to the claim, unless applicable law requires a different remedy.

15. Indemnity

To the extent permitted by law, you will defend and indemnify us against third-party claims, losses, and reasonable costs arising from your Input, Output, unlawful use, violation of these Terms, or infringement of another party’s rights. This section does not apply where prohibited by consumer law or to claims caused by our own unlawful conduct.

16. Changes and Contact

We may update these Terms to reflect changes in the Service, providers, or law. We will post the revised Terms and provide additional notice for material changes where required. Continued use after the effective date constitutes acceptance where permitted by law.

Questions, billing disputes, or legal notices may be submitted through the support channel available in your account or on this website. Before public launch, the Service must also identify the contracting legal operator, registered address, dedicated legal contact, and applicable governing-law and dispute forum information.
